Welcome to Enbiit, a freelance marketplace connecting clients with freelancers around the world. These Terms of Service ("Terms") govern your use of our website, platform, and services. By accessing or using Enbiit, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our services.

• "User": Anyone who accesses or uses our platform, including clients and freelancers.

           

• "Client": A user who posts projects or seeks services from freelancers.

           

• "Freelancer": A user who offers services or submits proposals for projects posted by clients.

           

• "Project": A job or task posted by a client for which freelancers can submit proposals.

       

3. Account Registration

To use certain features of our platform, you must register for an account. You agree to provide accurate and complete information during the registration process and to update your information to keep it accurate and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. User Responsibilities

           

• Compliance: You agree to comply with all applicable laws, regulations, and these Terms when using our platform.

           

• Content: You are responsible for any content you post, including project descriptions, proposals, and messages. You agree not to post any content that is unlawful, harmful, or violates the rights of others.

           

• Conduct: You agree not to engage in any conduct that disrupts or interferes with our platform, including spamming, hacking, or circumventing our security measures.

       

5. Service Fees

Enbiit may charge service fees for certain transactions or features on the platform. These fees will be clearly disclosed prior to the completion of the transaction. You agree to pay all applicable fees and to use our payment processing services for all transactions.

6. Payments and Refunds

           

• Payments: Payments for projects are processed through our secure payment system. Clients are required to fund their projects before freelancers begin work.

           

• Refunds: Refund requests are subject to our Refund and Cancellation Policy. We will assess each refund request on a case-by-case basis and process refunds in accordance with our policy.

       

7. Dispute Resolution

In the event of a dispute between clients and freelancers, we encourage you to resolve the issue amicably through our platform’s messaging system. If a resolution cannot be reached, you may submit a dispute for mediation by our support team. We will make a final determination based on the information provided by both parties.

8. Intellectual Property

           

• Ownership: Clients retain ownership of any intellectual property rights in the content they provide for projects. Freelancers grant clients a license to use any deliverables created as part of a project, subject to the terms agreed upon between the client and freelancer.

           

• Infringement: You agree not to infringe on the intellectual property rights of others when using our platform. If you believe your intellectual property rights have been violated, please contact us immediately.

       

9. Termination

We reserve the right to suspend or terminate your account at our discretion, without notice, for any reason, including violation of these Terms or engagement in fraudulent or unlawful activities. You may also terminate your account at any time by contacting us.

10. Limitation of Liability

Enbiit is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our platform. Our liability to you for any claim arising from your use of our platform is limited to the amount of fees you paid us in the six months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Enbiit, its affiliates, and its respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of our platform or violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on our website and updating the effective date. Your continued use of our platform after any such changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Assam, India for the resolution of any disputes arising out of or related to these Terms or your use of our platform.
